TEMPORARY RESIDENCE PERMIT - OTHER CIRCUMSTANCES

Who the application concerns

You can obtain a temporary residence permit based on other circumstances if you intend to:

  • take up or continue education in Poland;
  • take up or continue vocational training;
  • seek employment in the Republic of Poland as graduates of a Polish university

This category also includes temporary residence permits granted to:

  • clergymen, members of religious orders or persons performing religious functions in a church or religious association whose status is regulated by an international agreement, provisions of law in force in the territory of the Republic of Poland, or which operates on the basis of an entry in the register of churches and other religious associations,and if his or her stay on the territory of the Republic of Poland is connected with the performance of a function or preparation to perform such a function;
  • for minor children born in the territory of the Republic of Poland and unaccompanied minors staying in this territory ;
  • in connection with circumstances requiring a short stay
  • in other circumstances justifying a stay on the territory of the Republic of Poland for a period exceeding 3 months.

You may obtain a temporary residence permit due to circumstances requiring a short-term stay if you are staying in Poland because

  • you are obliged to appear in person before a Polish public authority, or
  • your presence on the territory of the Republic of Poland is required by your exceptional personal situation, or
  • your presence on the territory of the Republic of Poland is required by the interest of the Republic of Poland

Temporary residence permit due to circumstances requiring a short stay, you can obtain for the period necessary to achieve the purpose of stay, but no longer than 6 months. This permit can also be granted if the circumstances of applying for this permit do not justify your stay on the territory of the Republic of Poland for a period longer than 3 months.

  • A temporary residence permit for the purpose of study can be obtained for the period of study, more than 3 months not longer than 1 year, with the possibility of applying for another permit. In other cases, a temporary residence permit due to other circumstances can be obtained for the period necessary to achieve your goal of staying on the territory of Poland for more than 3 months to 3 years, with the possibility of applying for another permit.
  • If you are a minor, the application for a temporary residence permit is made by your parents or court-appointed guardians, or by one of the parents or one of the court-appointed guardians.
  • When applying for a temporary residence permit for an alien who is a minor who has completed 6 years of age on the date of application. one year of age, his presence is required. The obligation to submit fingerprints does not apply to foreigners who are under 6 years of age on the date of application,
  • Temporary residence permit due to other circumstances does not grant you the right of access to the Polish labour market. Employment is possible on a general basis, subject to the possession of a work permit, unless it is not required (e.g. for graduates of full-time studies in Poland, clergymen performing work in connection with religious functions).

Basic information:

  • you apply for a temporary residence permit in person, no later than the last day of your legal stay in the territory of the Republic of Poland;
  • you can only pick up your residence card in person;
  • you will be fingerprinted to issue a residence card;
  • documents should be submitted in Polish in originals or in photocopy along with the originals for inspection;
  • documents in a foreign language should be translated into polish by a Polish sworn translator.

Nesesery documents

  • 2 copies of the application for temporary residence completed in accordance with the instruction;
  • 4 up-to-date colour photographs, undamaged, measuring 45x35 mm, taken over the last 6 months on a uniform bright background, having good sharpness and showing clearly the eyes and face from the top of the head to the upper part of the shoulders; the face is to occupy 70-80% of the photograph; the photograph is to represent a person looking straight ahead with:

- if you have congenital or acquired defects of the organ of vision, you can attach a photo depicting you in glasses with dark glasses. In this case, you must attach documents confirming your disability and, in the absence thereof, your statement of disability

- if you wear a headgear in accordance with the rules of your religion, you can include a photo in the headgear, as long as the image of the face is fully visible. In this case, you must attach a statement of membership in the religious community

  • valid travel document (2 photocopies of all saved pages containing stamps, annotations and entries, original for inspection);
  • confirmation of payment of stamp duty.

Please note that the submission of the above documents is necessary to initiate the procedure. If you submit an application without any of the above documents, you will be called to supplement the formal deficiencies in the application. The proceedings may be initiated only after the missing documents are supplemented within the indicated time limit and after their positive verification by the Office.

Submission of applications and delivery of documents in matters of legalization of residence of foreigners and work permits will be carried out by mail or courier. In addition, for work permits, applications can be submitted through the portal www.praca.gov.pl
