TEMPORARY RESIDENCE PERMIT

To whom the application concerns

In accordance with the act of 12 December 2013 on foreigners (Journal of laws 2020, item 35), you may apply for a temporary residence permit for the purpose of undertaking or continuing full-time higher education or doctoral studies if the purpose of your stay is to study in the territory of Poland, provided that this circumstance justifies your stay in the territory of the Republic of Poland for a period longer than 3 months.

Conditions for authorisation:

Article 144 1 of the act on foreigners you may obtain a temporary residence permit for the purpose of studying at first-level, second-level or single master's degree studies or at a doctoral school if the purpose of your stay in the territory of the Republic of Poland is to undertake or continue your full-time studies or doctoral studies, hereinafter referred to as "studies", also if these studies are a continuation or supplement of studies undertaken by you in the territory of another member state of the European Union, and if you meet the following conditions together:

1) Submit:

  1. a) certificate of admission or continuation of studies by the institution,
  2. b) proof of payment of the fee, if you undertake or continues paid studies;

2) you have:

  1. a) health insurance within the meaning of the act of 27 August 2004 on health care services financed from public funds or confirmation of the insurer's coverage of treatment costs in the territory of the Republic of Poland,

(B) sufficient financial means to cover the cost of subsistence and return travel to the country of origin or residence, or the cost of transit to the third country which grants the entry permit, and the cost of studies.

Note

The amount of the monthly financial resources, after deduction of the funds intended to cover the cost of living, which you have to cover the cost of living, is higher than the amount of income entitled to cash benefits from social assistance as defined in the act of 12 March 2004 on social assistance in respect of you and each member of your family who remains dependent on you. It is considered that the cost of living referred to above includes at least the amount of fixed charges related to the operation of the occupied premises in terms of the number of people living in this premises, as well as charges for the supply of energy, gas, water to the premises and the collection of sewage, waste and liquid impurities.

When determining the amount of monthly funds that you have for living expenses, the funds intended for living expenses, in accordance with the requirements set out above, are not deducted, provided that you are a citizen of one of the states specified in the regulation of the council of ministers.

  • In accordance with Article 144 (2). you will also obtain a temporary residence permit for the purpose of studying at a university if you intend to take a preparatory course for studying at that university and you meet the conditions for residence for the purpose of Undertaking or continuing a full-time university or doctoral study, if you are a citizen of one of the countries specified in the
  • In accordance with Article 144 (3), you will also obtain a temporary residence permit for the purpose of studying at a university if the studies which follow-up or complement the studies you have undertaken in the territory of another member state of the European Union are not covered by a Union programme or multilateral programme including mobility measures or by an agreement between at least two higher education institutions providing for intra-union mobility and you fulfil the following conditions together:

1) you meet the conditions set for your stay in order to undertake or continue your full-time university studies or doctoral studies;

2) a study centre has been approved by the minister responsible for the interior, unless this centre is not subject to approval or a decision on the admission of foreigners, as referred to in Article 144A (1), has not been issued in respect of a study centre which is not subject to approval.

Necessary documents:

  1. Temporary residence permit application form completed as instructed;
  2. Four photographs meeting the following requirements:
  • undamaged, colorful, with good sharpness;
  • dimensions 35 mm x 45 mm;
  • made not earlier than within 6 m-cy before the date of submission of the application;
  • depicting the image of your face from the top of the head to the upper part of the shoulders, so that the face occupies 70-80% of the photo, on a uniform bright background, in a frontal position, looking straight ahead with open eyes, unshaven hair, with a natural facial expression
  • and closed lips, and also reflect the natural color of your skin;
  • showing your eyes clearly, especially your pupils, the eye line is parallel to the top edge of the photograph;
  1. Proof of stamp duty 340zł;
  2. Copy of valid travel document – all pages (original for viewing);
  3. Certificate of admission to study or continuation of studies-on the form;
  4. for a fee;
  5. Documents confirming the possession of health insurance or confirmation of the insurer's coverage of the costs of treatment in the territory of the Republic proof of payment of the tuition fee, if you undertake or continue to study in Poland, for example, an appropriate certificate from the ZUS or insurance policy;
  6. Documents proving sufficient financial means to cover the cost of subsistence and return travel to the country of origin or residence or the cost of transit to the third country which grants the entry permit, and the cost of studies.9. Documents demonstrating the amount of funds intended to cover the cost of living (the cost of living includes at least the amount of fixed fees associated with the operation of the occupied premises in terms of the number of people living in this premises, as well as fees for the supply of energy, gas, water to the premises and the collection of sewage, waste and liquid impurities)
  7. Documents indicating the amount of funds allocated to housing costs (housing costs include at least the amount of fixed charges associated with the operation of the premises occupied by the number of people residing in the premises, and in addition charges for the supply of energy, gas, water and collection of sewage, waste and liquid waste)
  • Cost of living: the amount of monthly financial resources, less the funds allocated to cover the cost of living (the cost of living includes at least the amount of fixed fees associated with the operation of the occupied premises in terms of the number of people living in this premises, as well as fees for the supply of energy, gas, water and the collection of sewage, waste and liquid impurities to the premises), which the foreigner has to cover the cost of living should be higher than the amount of income entitled to cash benefits from social assistance as defined in the act of 12 March 2004 on social assistance in respect of you and each family member who is dependent on you - should exceed PLN 528 for persons in the family or PLN 701 for single persons.
  • Travel costs:
  • 200 PLN if you come from a country neighbouring Poland,
  • PLN 500 if you come from a member state of the European Union not neighbouring Poland or from a member state of the European Free Trade Agreement (EFTA) – a party to the agreement on the European Economic Area or from the Swiss Confederation,
  • PLN 2500 if you come from a country other than the above

- or the equivalent of these amounts in foreign currency. If you came to the territory of Poland with a member of your family, you must have the above-mentioned funds also for each member of the family.

The documents that can confirm the possibility of obtaining funds to cover the costs of the return journey are:

  • traveler's check;
  • certificate of credit card limit issued by the bank that issued the credit card;
  • certificate of cash holdings in a bank or cooperative savings and credit institution established in the territory of the Republic of Poland;
  • other document confirming the award of a national or foreign scholarship;
  • certificate of employment and the amount of earnings.

The certificates referred to above shall be issued not earlier than one month before the date of submission of the application for a temporary residence permit.

Note: if it is necessary to clarify or clarify the evidence held by the authority in the case during the proceedings, you may be asked to provide other documents or to testify in support of the circumstances referred to in the request

Method of application:

You submit your application in person to the Voivode competent for the place of your current residence.

When submitting an application, you are required to submit fingerprints

If you do not submit your application in person or send it by mail-upon delivery of the application to the governor, you will be summoned to appear in person within no less than 7 days from the delivery of the summons under the rigor of leaving the application without examination.

  • if you apply for a temporary residence permit you are obliged to submit your application in person, no later than on the last day of your legal stay in the territory of the Republic of Poland to the Voivode competent for the place of your current stay.
  • If you have completed 6. year of age when applying, you are required to submit fingerprints.
  • If you have submitted an application within the deadline and it does not contain any formal deficiencies or you have completed the deficiencies within the deadline, the governor shall put a stamp in your travel document confirming the submission of the application. Your stay in the territory of the Republic of Poland is considered legal from the date of submission of the application without any formalities until the day when the decision on granting a temporary residence permit becomes final.

Look out! Putting a stamp in the passport does not entitle you to travel on the territory of other Schengen countries, while a foreigner can go to his country of origin, but to return to Poland he must obtain a visa if he comes from a visa-free country.
